80-Year-Old Chicago Man Kills Armed Home Invader

Elderly Homeowner Shoots Suspect Dead in Garfield Park Home Invasion - Chicago News

An 80-year-old Chicago man shot and killed an armed man who broke into his two-story house in a pre-dawn home invasion Wednesday on the city's West Side.

At about 5:20 a.m., the homeowner and his wife, also in her 80s, discovered the intruder entering their home through a back door. The homeowner, who had a gun, confronted and killed the burglar on the doorstep, police said. Cops said the intruder also fired his gun during the struggle.

"It's a good thing they had a gun, or they might be dead," said Curtis Thompson, who lives next door to the couple, the Chicago Sun-Times reported.

Neighbors described the elderly couple, who both walk with canes, as pillars of the community in Garfield Park, where home invasions have been all too frequent.

Their neighbor, Shaquite Johnson, told MyFoxChicago that the two are "heroes" for fighting off the attacker — and that the shooting means there is "one less criminal" walking the streets.
"They don't bother no one, so why would anyone do that to them?" she said.

Relatives of the couple told the Sun Times that the man is an Army veteran, his wife a former nurse. Police said neither the man nor the woman was injured in the attack.

The assailant, who was described by police as being in his 30s, was found slumped on the back doorstep of the couple's house, removed four hours after the shooting, the Sun Times reported.

No charges have been filed against the homeowner, but Chicago currently has a statute outlawing the possession of handguns. Its legality is currently being decided by the U.S. Supreme Court.

A high-profile Chicago attorney has already stepped forward offering to represent the man pro bono if he faces charges for possessing a weapon.

"Self-defense isn't just a right, it's a duty," said attorney Joel Brodsky. "If this man is prosecuted for saving his own life it's not just a travesty, it's justice turned inside out."

I'm pretty sure Daley, Dick doesn't want any charges here...it would be counter to his agenda. I heard on the radiothis AM that CPD doesn't plan on pressing charges. Can you imagine the outcry if they threw the old man in the slammer? Daley would lose his mind for sure.

If this had happened in Kalifornia, I guarantee he would have had charges on this. Can't shoot them if they are not inside your home.

I will be stunned if they aren't trying to figure out a way to prosecute this man. Typical Chicago politics. This man can't be allowed to go free, guns are bad, and must be taken away period.

The radio said the perp fired a sho through the window to break it after he couldn't get into the main house after breaking into the basement. The perp fired a second shot, and that's when the old man let him have his just deserves.

I kinda wish they would press charges against the old man. I would incite such an out pouring of common sense and support that Daley will be crying in his bath water.

in IL and even some castle states, u can shoot the invader as long as he's inside your door. and it's best advice to shoot to kill. because if he dies inside your house, it's self defense. if he stumbles and gets outside your door, it's manslaughter. yea it's ****ed up...

I did not say it is right, I said it is the law of the land of fruits and nuts. You could look it up. If they are not inside the house threatening your life, cannot shoot them. Criminal and civil repercussions. Estate of deceased scumbag would certainly sue and win.

Here's a dirty little secret: this happens all the time in Chicago, and the homeowners are rarely prosecuted. Unless drugs or a long rap sheet are involved, the homeowner doesn't get charged?

Why? Because Daley knows his ban in vulnerable, and he doesn't want any legitimate challenges. Yeah, that didn't work out (Otis McDonald). Daley knows that most non-criminals will obey his ban, and that's good enough....for now.

There's a provisoin about shooting somebody if they are in the act of forcibly entering your home. I couldn't find it with 10 minutes of searching, but I know I've seen it before. If I can find it later I'll post it.

DC leaves you alone for justified shoots too. They did go after a guy once, but only after he started talking to the media about it and making a stink about how all DC residents should be allowed to defend their homes. The NRA got him a lawyer and the case went away.

I'm not sure the Chicago hand gun ban has the power to put anyone in jail. The worst they do is take your gun away. Time's a tickin' on that ban anyways.
