I can easily see how this can happen to someone who flys locally off their own home grass strip in a low slow vfr airplane.
I can say in the 300 or so hours I have put on my wood/fabric ultralight (which has close to the same performance as her cub) I have seldom called in for a briefing. Most flights in this type of airplane are simply for a short jaunt around the patch on a warm summer evening. Prior to 9/11 even in my certified airplanes, if I were simply flying from my home strip to a friends strip or local county airport 20 miles away, I would rarely do more than a brief check of the forecast. Longer non-local flights get more in depth planning/briefing. A few weeks ago, had I not heard that Obama was coming to Toledo on the local news, I probably would have had the same thing happen to me as I planned to buzz over to a local county airport to top off my tanks prior to an upcoming cross country flight... Luckily I remembered hearing that Capt Zero was stopping in Toledo, so I checked on-line for TFRs and had to wait until the next day. All that said, when campaign season starts, I find myself checking TFRs often due to Toledo's recent additional new solar cell companies attracting the politicians. Pilots who live in heavily populated/restrictive airspace will not understand how this is possible, but us guys who still live outside of cities and mostly fly for fun rarely feel it is necessary to get a full briefing or file a flight plan to drag the taildragger out for a relaxing 10 minute flight around the patch on a warm clear summer evening.

It's a pain in the azz when the Pres comes into town. If you have a (flying) business at one of the local airports that is covered by the TFR (Temporary Flight Restriction), you're shut down until he's gone. Thousands if not tens of thousands of dollars in lost revenue so the Pres can have his fund raiser or play golf.

I was flying out of Hope AR back in the 90's when Bill Clintons "Uncle buddy" died. We would land at night when we came in at a Best Western motel I believe it was. We left the day before Bill came in for the funeral. I've often wondered what kind of reception we'd got if I'd whipped into the lot behind the motel and him there. The Jetranger had an Isolair spray system on it and the chemical tanks looked like big bombs. Imagine I'd have been warmly welcomed!

How slow can you go?
I did not know that an F16 could fly that slow! I saw a squadron of Cubs at an air show one time that had a 30 knot wind to fly into and they were virtually motionless in the air. I'd bet that the F16 fire system would have a difficult time getting a lock on a Cub. Kind of like the British Fairey Swordfish biplanes that torpedoed the Bismark, the fire director controlled guns on the Bismark could not track the Swordfish because the system was designed to work against (then) modern aircraft!

This is the most obvious one they're going to nail her with. No excuse for not checking these things in the Age of TFRs. None. If she'd gotten a briefing and gone up and the TFR popped into existence while she was in the air, she might have some recourse. I feel for her, but just saying "well I live in the country" doesn't give one a pass on due diligence as PIC.

Each pilot in command shall, before beginning a flight, become familiar with all available information concerning that flight. This information must include— (a) For a flight under IFR or a flight not in the vicinity of an airport, weather reports and forecasts, fuel requirements, alternatives available if the planned flight cannot be completed, and any known traffic delays of which the pilot in command has been advised by ATC; (b) For any flight, runway lengths at airports of intended use, and the following takeoff and landing distance information: (1) For civil aircraft for which an approved Airplane or Rotorcraft Flight Manual containing takeoff and landing distance data is required, the takeoff and landing distance data contained therein; and (2) For civil aircraft other than those specified in paragraph (b)(1) of this section, other reliable information appropriate to the aircraft, relating to aircraft performance under expected values of airport elevation and runway slope, aircraft gross weight, and wind and temperature. - - - - - Yes this is a stupid incident and she obviously represented no great threat, but these are basic and fundamental rules & procedures every student pilot knows before they even solo - or should. They'll probably try to hit her with 91.13 ("nasty number 13") which is the "catch-all" regulation prohibiting "careless and reckless operation". I hope like crazy she files an ASRS report and gets a damn good lawyer (and/or is a member of AOPA's legal services plan, but even so I'd be stunned if she got out if this without a certificate action). Sucks, but that's the state of aviation in this country - rules on top of more rules on top of more rules... And no matter what, it's ALWAYS going to be the PIC's fault. This is one big reason I got out of flying as a profession - It's gotten to the point where the liabilities outweigh the benefits/enjoyments. It certainly outweighed the compensation. Just one more activity destroyed by too many lawyers and too many well-intentioned bureaucrats who "know what's best for you". Big government at its finest! |

Unless I had heard on the local news that the prez or vice prez was going to be in Ohio, I am quite sure that a TFR would never cross my mind and because the flight would be local within a 5 mile radius in 10 mile visability/clear skys and returning to my grass strip, we would have all the info we needed (other than the maybe two times a year a TFR is in effect for Toledo). Once again.... the lady technically screwed up, but I can see how it could happen to an "around the patch" flight from a grass strip.
