BS ticket and I am pissed
I just got done with this proposal for tomorrow morning and I need to sleep before I do battle tomorrow. I want to have some time to b!tch a bit. I was caught in bad traffic this afternoon coming home and decided to get around and go through the outer rim of downtown LA. I was stopped at a red light waiting for it to turn red. Goddam no turn on red made me stay put and they are all over the place now (How about your cities?). Cop car came up behind me and we sat. I was driving my S2000 with the plastic cloudy window and he can't see what I am doing. A beautiful late 20's women was leaning against a light pole screwing around with her phone waiting also. lights changed, I wait for her to cross for about 5 second and she still on the phone and not notice the light had changed. Cop toots that siren so I go. AS soon as i went around mid corner, this absent minded b!tch decided to walk onto the street. I don't even she even looked if the car is there. Of course, I had no choice but go on through because she was right by my door. Cop lit me me up and gave me a ticket. That fcuker told me he didn't want to hear it. Any chance I will win in court? I am thinking its been more then 18 months so just bite the bullet and pay the fine and deal with traffic school. Fcuking phones.

I would've asked to have his supervisor come to the scene and had her stopped also......
Maybe she worked for the city and it's a scam..... I would fight it, but unfortunately it's going to be hearsay with no witnesses..... Maybe do some research on similar tickets with that judge and see what the majority of lodgements were before you try.....our consult witha local lawyer on it......

If all of the circumstances are exactly like you described, it is indeed a BS ticket. I do think that most *failure to yield* tickets are legit but this is wrong if she would not move and the cop told you to move, via his siren.
Are you sure that he was not alerting her to move?

I wonder if they have dash cams? even if they did, how wide of an angle and will it pick up the women stepping off.

Ah, on the duplicate thread. Here's my take from the other identical thread: You should have stood your ground or gotten out of the car. But now that you have the ticket, do not admit that the woman was in the cross walk. Lie and say she waved you on. Yes, this one is for the court. I'll remember this thread in case a dumb ass cop prods me to move against reason. BTW, be sure to say to cop hit the siren, not the horn. For all you know, he just got a call and was "moving" you out of his way. Yeah, I think yo have ths one licked but sorry that a stupid cop is going to cost you hours at the courthouse. Mile, I don't think the bastard ever saw the girl until she step foot on the street. Hell, maybe he was on the phone like everyone else. He has his siren on because I did not move right after the light change. 5 seconds is a long time waiting with a green light. He must want me to get going not knowing someone is waiting there to get across.

Take a picture of the intersection and do a trial by written declaration. If that does not work, you have a chance for a trial de novo, in which case you go before a judge and have a second chance at getting out of the ticket.

Pretty much. Get an angle of the intersection that shows where you, the cop and the ped were. Number the points on the pic and give a detailed statement on what transpired. It can't hurt and gives you two chances to beat the ticket.
I don't know if this helps, but I waited until the last minute and got an extension to file the TBWD. Mostly because I procrastinate. Once you hand in your declaration, then the court sends a notice to the cop, who then has the chance to respond. By delaying things, I've wondered if it helped make the cop forget (despite what ever notes he had) details. If you do go this route, do yourself a favor and write down the details of what happened ASAP, so you don't forget. ![]()

Unfortunately, this is one of those times where it's better to just pay the stupid fine than spend a bunch of time and aggravation fighting it. It sucks, but you probably won't win this one.
