Grr, dickhead cop gives me 26 mph over limit speeding ticket

First off, I know I was speeding, I was wrong and deserved a ticket. I was heading home after a long drive up I-5 and just outside of Stockton, I got pulled over by CHP. It was on the long stretch of I-5 just past the 580 split and traffic was really light. I was cruising along between 88-90 (I know, already said I was wrong) and the cop writes I was going 96. I questioned this and he immediately said he used radar and I was probably going faster (huh?) and he would bring the video to court if I wanted to go that route. Don't know if it was because it was hot or what but he flipped out for no reason. Obviously it was useless arguing with him but now I find out that anything over 25mph over the limit does not qualify for traffic school. This was the first road trip in my 968 and he sure showed that must-be-arrogant Porsche driver, I'll give him 26 mph over the limit so it goes on his insurance.

FU!

BlueSkyJaunte 07-01-2013 03:27 PM

Insurance? Pfff.

That's felony speed here. As in, "Go to jail."

Rick V 07-01-2013 03:31 PM

Dude, you do the crime you do the time. Sorry but the cop was just doing his job and there is nothing that says he has to cut you a break.
Yeah it sucks but it is what it is.

biosurfer1 07-01-2013 03:33 PM

Well I guess that is where we disagree Rick. I was NOT going 96 mph, I don't care what you or the POS cop says. He lied, period.

Rick V 07-01-2013 03:35 PM

I hope your right, that kind of ticket will leave a mark. Good luck, and that was not sarcasm

Tobra 07-01-2013 03:35 PM

You definitely want an attorney for that one. At first I was thinking you were in the 914, does that even go 26 over? Dig the 968, great cars.

Was that yesterday? I was on that same road, heading back from an autocross at the Marina Airport, traffic was not what I would call light around 1730-1800. I hope you were past the construction, double fine in areas marked as construction, even though I have never seen anyone actually working out there. Holey moley it was hot.

biosurfer1 07-01-2013 03:37 PM

Thanks...I know I deserved the ticket and would pay the fine, as much as it hurts, but this was on another level.

biosurfer1 07-01-2013 03:38 PM

No, Toby, it was about 3 hours ago. I don't think it was a construction but who knows, sometimes they aren't marked.

I was going to say something similar. I'd plead not guilty if you truly know you weren't going 96. Let him produce his video. Oh you could have requested that the gun be quarantined and ask for the calibration records. If it has not been done in the allotted time your off the hook.
Good luck and let us know what you plan to do & results.

Dude. You shoulda put the hammer down. :D

craigster59 07-01-2013 03:44 PM

I think this one warrants hiring a ticket lawyer. At least get it lowered to where traffic school is an option if the ticket doesn't get dismissed altogether.

scottmandue 07-01-2013 03:46 PM

Dude... you can cruise all day long on I-5 at 80MPH (***cough, in a Hyundai, cough***) and the CHP will buzz right past you (yes, it has happened).

Rumor is the CHP will give you 5-10 over the limit... you were (pardon the pun) over the limit.

Sorry man, I know it sucks... I got a cali stop ticket (my bad) and after traffic school it was over $300

That doesn't seem to work out for the guy I see on "COPS" :D

Its the no traffic school that really irks me. First ticket since I started driving 16 years ago and now it will go on my record. Can't wait to see what the extra cost will be on my next renewal.

It's crazy how many stories around the internet of people getting EXACTLY 26 mph over the limit:rolleyes:

How much are we talking about for a traffic ticket lawyer? I couldn't seem to find any reasonable answer from my searches.

Drisump 07-01-2013 04:07 PM

Be thankful you didn't get that "26 mph over" in British Columbia. They take your car for a period of time (fines and storage$), bump up your insurance premiums and the total bill will amount to over $2k. If you're sure that the cop has fluffed up the speed, I'd definitely go the court route. Cheers and good luck.

Lawyer up.

In NY anything 25+ over posted is automatic revocation of your license.

gatotom 07-01-2013 04:27 PM

how much for a good lawyer, easy 600.00.

Usually the lawyer will do a plea bargain with the judge, since it's your first ticket in 16 yrs they would ask for ticket dropped if you don't get a speeding ticket thru the next yr and if you do the ticket stands plus the new ticket, so that would be a big ouch.

Or, I would go to court myself and ask the judge for mercy admit to 16 over and ask for a stay of execution for 6 months and if no ticket in that time, ticket dropped and pay for court costs before you leave the chamber.

For the 18 yrs I had my last Porsche I only got one ticket and that was with laser. I had a detector plus a jammer, worked very good. Anyway, was cruising on I-84 just past Hood River when the laser went beep, I instantly took the foot off gas which I was going 85 in a 65, slowed down to 75 and heard the second beep, which by the rule books they have to do. When I saw him I saw his lights come on and I pulled over almost where he was. Long story short, the book says on laser the second beep is the one they have to use, not the first, the cop wouldn't budge. I sent the ticket in but explained to the judge that I was a chronic speeder that has learned, see my record, and told him I was only a 10 over guy and since my last bunch of tickets were only 10 over, most have been lowered cuz cops are only doing there job and since the second beep was only 10 over, he bought it and sent me a refund.

I got hit for......26 over coming out of Marina Del Rey on the 90 just as it goes over the 405, in a rental SUV... No way I was 26 over, but that's what he wrote me up... When I questioned his "opinion" of my speed... You know what he did?

He said, "have you been drinking?" "I think I smell alcohol". No BS!

That told me to STFU and take it like a man...

I did

When I went to court the judge started the morning in a good mood and slowly thing went down hill with all the riff raff she was dealing with... Having been Pre-law...I argued... Kidding!

I got up there and didn't argue the speed, I threw myself on the mercy of the court in a respectable manner. Judge hemmed and hawed but eventually gave in to my smile, confidence and reasoning :)

Got traffic court but had to pay the ticket.

Ticket was somewhere around 100-200. I thought ok, that's doable. Then at the court cashier I found out about the BS fees that notched it up to nearly $800! No joke, plus traffic court.

That's the last time I ever cruised in traffic without my V1, period...

Go to court - he has to prove you were going 96 - and you have a right to stand up for yourself. You might even consider getting a lawyer to help you - your call.

I haven't had a speeding ticket in ions...although I speed every day. :p
