The MIL is saying I should lawyer up, but she's a court reporter, so I think its in her blood.

Give 'em a chance to do the right thing. A lawyer will up your award but take 35% of it. And you'll be feeding a nasty system. Insurance companies are bad enough. Insurance companies+PI attorneys=crime family.
The same could be said about the people who buy Porsches and immediately sell them at 35% more. It's a nasty system.

I saw my GP and my chiro.. They say I'll probably live, but I'll be sore for a while.

Keep all your medical receipts, don't settle on the personal injury part too soon, they will pressure you to do so.

I was a little sore the first few days. Been about 18 months and I am hurting every day. Still can't swing a golf club or run more than about 50 feet. I used to run several miles every day.

I finally heard from the insurance company about the disposition of the car. I'm not sure where to go from here with respect to wringing a little more out of them for things like the wheels, recent mechanical improvements (new clutch, cats, trans mounts, etc, etc, etc)

Provide a list of enhancements to your claims adjustor. Provide realistic values and date of purchase for each. If you have receipts, all the better. They should reimburse you for the enhancements.

Oh man, that was a beautiful M3.

I hope there are no injuries that crop up later.

I'd say that is a good starting offer from them. Edmunds valued it at $14,500. If they give you that price and the car back with salvage title, I'd go for it. I'm sure you could get another $5k parting it. That said, you could explain to them that finding another one in equal condition is very difficult, and because these are enthusiast cars with much lower production numbers than a Toyota or Chevrolet, the appraisal data books (Edmunds, KBB, NADA) are inaccurate. then provide a list of "comperable" cars for sale by showing the highest priced cars on popular ad sites (cars.com, ebay, autotrader, bimmerforums, etc.) There are a couple e46's on cars.com in the mid $20k's. Hopefully that gets you some more money.

I've never had a car stolen, but did have our house broken into years ago, and had to go through all kinds of trouble to show that my stuff was worth more and harder to replace than their initial "replacement" offers indicated.

One way to deal with the replacement value is to say, "Fine, I don't need any money. Just bring me the same model and color that is at least as good." Do provide receipts for any parts or work done in the last year or so. I did this and it worked.

I think that next time I am rear-ended (if it ever happens again), I will leave the scene in an ambulance. I HATE insurance companies. All I'd be interested in is full replacement or proper repair of the vehicle. But without leverage, you won't get either of those things.

Just a quick update. I finally settled with the insurance company on the material side of the claim. They originally offered me $16k and change, which I rejected, so we went back and forth for a few weeks. I finally wore him down and they settled for $21754

Is that a fair settlement for an E46 M3 in that condition with 100k? I haven't been paying attention to the value of those cars.
