Who's right on this eBay deal?

Short version is that I didn't read the item description closely enough, but seller had only one stock photo of a guitar that wasn't what was in the description. I bought based on the photo, but what I got was what was in the description text. It's a Fender Standard Strat in cherryburst. Photo had a Floyd Rose bridge, which is what I wanted. Item description read "vintage tremolo," which no guitar player would mistake for a Floyd Rose bridge. I haven't heard back from the seller yet, but I have no use for this guitar. What's gonna happen?

Hopefully he'll just let you off the hook.

I think if you buy it, you buy it, and poorly created listings don't really matter unless there's some explicit misrepresentation.

Save the listing (screenshot etc). If seller has a good feedback score to protect, he'll likely agree to refund, you pay return shipping. eBay is pretty skewed in favor of buyers.

Ok, you didn't read the ad properly but the photo was a wrong.

Wait for the seller to get back to you and if he won't let you off then complain to eBay. I bet they side with you.

Even though the text part of the ad was correct, he misrepresented the item in the photo unless he had stated the photo was a stock photo or other. I purchased a Gretsch Duo jet from AMS and I ordered it with out a tremolo however I got a guitar with one! It was more expensive. They absorb the cost and let me keep it.Email him one more time.[ /COLOR]

The ad may or may not have been intentionally deceptive or misleading, but it was wrong (or just stupid) for him to use that photo. I'll bet ebay would side with you if you pressed the issue.

This is the ended listing. If you know guitars, you immediately noticed the Floyd Rose, which is why I even clicked on the listing.

Can you post the text? People use stock images all the time, and it's entirely possible the seller didn't even notice the bridge. I'm no lawyer, but I think you might be SOL on this one.

I'm sure you'd have no problem returning this. He's got an eBay store and high feedback rating, so this is a legitimate business for him. He needs to protect his reputation. He definitely does not want bad feedback.

Email him, I'd bet a buck he'll refund your money to keep you happy.

Yeah, I'm watching that, but it's a little pricey for not being NIB and I'm thinking I need to stick with 22 fret necks.

He's a legit dealer with over 1,000 items for sale at this time. I'm sure he would refund as long as you paid shipping. Ask him if he can get a hold of one with a FR for a decent price and you'll buy it from him.

When buying stuff on line, i always always use a credit card.

That way if a deal goes south i can always stop the charges.
Plus if the seller is a douche i can offer him two options:

1) refund my money (including paypal fees) and I'll ship the merchandize back to you.
2) I call the credit card company and cancel the charges and you get nothing.

yes, I know it can get more complicated than that but just saying that should do the trick.
