Selling private party spoons in Cali, How to?

Trying to sell off unused useful stuff to make useful cash for me, but have never sold a spoon.

I presume I can run an ad at calguns or gunbroker and then I run the deal through a spoon shop to do the paperwork? Who pays for the paperwork? How much is the paperwork?

I have a Ithaca Model 37 that is +20 years old and never been fired.

And a Jennings 9mm that I took to the range once then cleaned and threw in a drawer.

I figure I will enjoy buying parts for my car more than having these objects collecting dust.

Yes advertise on Calguns or GB. Meet the buyer at a local gun store or FFL, complete the paperwork on site. You will only need your ID. Buyer needs ID and, if a handgun, valid handgun safety certificate (HSC) and proof of CA residency (auto registration works). Buyer typically pays for the DROS and transfer fee but that is negotiable and is ~ $30. Gun stays at the store, you get the sale money, buyer comes back after 10 days to collect firearm.

The Jennings will need to go through an FFL. since it is a pistol.

The Ithaca 37 may or may not need to go through an FFL, depending on its date of manufacture. If it is 50 years old or older, it is a Curio and Relic (C&R), and you can sell it to a non-prohibited person face-to-face without an FFL. If it is newer, or if you can not tell for sure, you need to go through an FFL.

If you go through an FFL, the buyer should pay the fees for the person-to-person transfer. Those fees vary by FFL, but there will be a Dealer Record Of Sale (DROS) and the transfer fee charged by the FFL. The DROS is $25, the transfer fee varies.

Gov Brown signed some new laws that I am not sure affect the C&R transfer. But those don't go into effect until 1/1/14.

Thanks David and Joe.

The Ithaca is max thirty years old so I will need a FFL for that.

The Jennings has fifteen round magazines that were legal in Calif. at the time, will that be a problem?

Would it be worth looking into doing consignment at a store or is that a big loss for me money wise?

Consignments are a bust generally for a seller. I agree with Calguns and/Gunbroker. In all cases, specify the buyer pays shipping, taxes and transfer fees. For the handgun a safety cert is generally required unless military, ex-military or retired. Sell the hand gun without the mags and then "find" them a week later.

Be very aware if a buyer wants to offer more $$$$ and tries to get you to bypass the FFL as it might be a sting and you will be in big trouble if you agree.

I would like to get a .357 revolver someday.

How would I legally work a trade with the 9mm for a revolver?

A Jennings 9mm - even brand new - isn't worth much. Not sure if your pre-ban mags can be transferred in the state or not....

The Ithica you may actually do better by listing on gunbroker ... or waiting for someone here to send you a PM.

I was going to take the Jennings to one of those buy back things the police do... but people were camping out the day before to trade in their guns I don't want to get rid of it that bad.

I have seen beat up 37's on GB go for hundreds... I never really thought about it... but a pristine example might be worth something to someone.

Scott, if you're interested in any trades, I have some gun, guitar and Porsche clutter. I sold my dad's Ithaca 37 for him at a gun a show in VA a while back. Really regret not keeping it, but I like my Mossberg Mariner better..... which I later traded and also regretted.

As has been stated, they have to go through an FFL, you can't sell the magazine to a CA resident. Until the end of the year, you can take it apart and give it to the buyer as parts, they can then make it into a legal 10 round mag, or keep it and assemble out of state if they travel back to America to shoot.

Fees for face to face transfers are set by law, I don't remember how much, but it should be the same wherever you go.

I would keep the pistol, you won't get much for it, and you won't be able to replace it, and definitely not a standard capacity magazine.

There's no way to do this. I've mailed plenty of guns to FFLs. They don't verify anything on my end.

still got the 37? we won't even take a jennings in trade. wait for LA to do a buy back and you'll make more money. I need an older the better 37 in 12 ga to complete the brace.
