Car insurance companies getting sleazier?
On Nov 8, I was driving my street/track 911 to be tech inspected for a DE the next weekend, when I was hit by a driver who ran a stop sign.
![]() Other driver was NOT the car owner, but car owner showed up at the scene and provided proof of insurance. Other driver was cited for failure to yield and driving with expired license. Now, the other guys insurance company, Georgia Farm Bureau, is denying coverage based on: the drivers license was expired. Is there no limit to how low insurance companies will sink?

That is ridiculous, would they not still have to cover, then persue the other vehicle owner for allowing an unlicensed driver to operate their vehicle? Seems insane that this becomes your issue.

Mine is GEICO, but that is another story of my own stupidity at work, so let's just say my car wasn't covered for this kind of accident. Like I said, my stupidity.
But I have a lawyer now, so keeping fingers crossed.

If they're accepting someone's payment in exchange for insurance my guess is that they would end up with a duty to defend if you filed suit against the driver and owner.

The driver, of course, had no insurance as he owned no vehicle. Your own company typically would cover the loss under the uninsured motorist property damage coverage, but that is not mandatory and may not even be offered in your state. Seems like you are left with a civil suit against the owner and the driver. I wish you well.

That is a nasty crash. Were you injured?
I can't add much but to say sorry for the loss of your 911. I hope that you can get some satisfaction from the guilty party or one of the insurance companies.

I wonder what your insurance company will say when they find out you were driving your car to do something related to a track event. Even though you were not on the track, you were planning to go, and probably have in the past. Unless you have DE coverage, they may not be too happy.
Hope you were not injured. Bummer about your car for sure.

I had some injuries, but I was lucky it wasn't much worse. 911s are tough little things.

Nothing sleezy to me, someone without a driver's license wouldn't have driver's insurance, you have to have DL to take out DI.
Its between you and the guy driving, and he's gonna be in water driving uninsured. If you have insurance for uninsured motorist, then cover it with your insurance, and let your insurance lawyers go after the guy. Imagine someone had stolen your Porsche, and then got in an at fault accident, would you expect your insurance to cover an at fault accident, and jack your rates accordingly? The guy who hit you is on the hook to get a replacement car.

These posts about accidents and problems with the poster's insurance and/or the other guys insurance turn up more than those asking what to do about that weird swelling on the side of my head or the reason my foot is at a weird angle! I learned in 1967 that if you do not have the card of an attorney in your wallet then you will suffer. Two of my daughters had wrecks, the neighbor's daughter across the street and next door neighbor's wife all had accidents where a driver ran either a stop sign or red light! In ALL these cases the other persons insurance refused to pay, the reason was "if you had not been there, you would never have been hit"! This is not just a weird CA thing as two of these are in AZ and finally all of them had to get a lawyer and sue. All were settled out of court, they all got their cars fixed w/o any costs and the lawyers all made some $$$$.
I would recommend an attorney ASAP, even in GA. |

I was going to say get a lawyer. Good on you for doing this. I have a lawyer who is a real Rottweiler. Expensive, but it sure works in my favor each time.

My thoughts exactly. I'm afraid this will be like getting blood from a turnip in any law suit. No assets, low income, no way to pay. Win a judgement but there's no way to collect. Best bet would be to go after the owner of the vehicle and show liability in allowing an unlicensed driver to use his SUV. The OP's lawyer is all over this, I'm sure. I hope I'm being overly pessimistic, but on the surface, it doesn't look to be easy, IMO.
