Did TV Anchor Violate Gun Law? - Yahoo! News Washington police are investigating whether NBC's David Gregory broke the law by holding up what appeared to be a 30-round gun magazine on Sunday's Meet the Press despite being denied permission by police to bring the weaponry on the show.
It is illegal in the district to possess a "large capacity ammunition feeding device." So in D.C. Crazy stuff does not only happen on Capital Hill. could it have been a MOVIE PROP? |

It's going to be interesting to see how they try to wiggle out of this one. Of course, Mr. Gregory is a neon blue liberal who is STRONGLY in favor of gun laws, yet he violated one that comes with a severe penalty. But, you know, he's a liberal, so it's OK for them to violate the law.

My first response:, I can't believe it's against the law to simply own a "large capacity" magazine. I mean, I know it's DC, but ... seriously? My initial instinct was to just ignore this as DC police just going crazy again.
Then somebody pointed out that he's seriously anti-gun. So I amend my stance: I'm with the "measure him by his own yardstick" camp. If he's seriously anti-gun, what's he doing with an illegal gun accessory, anyway? 10 years in the slammer for ya! I'm looking forward to the protests against this "injustice."

yep, especially after they were told NO! Looks like we have a little game playing going on here.
Gwendolyn Crump, director of the Office of Communications for the Washington Metropolitan Police Department, told ABC News, "NBC contacted MPD inquiring if they could utilize a high capacity magazine for their segment. NBC was informed that possession of a high capacity magazine is not permissible and their request was denied. This matter is currently being investigated." |

If he did break the law, then hold him to it.
However, IMO... Unless the police showed up and seized the item, they have no physical evidence. The video footage will not be admissible, as it is unclear from the video alone if the item was real, or a prop. edit: Removed TMZ info, as Seahawk beat me to the post.

TMZ reports that a staffer from “Meet the Press” called the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives before the show aired to inquire about the legality of Gregory holding the empty magazine during a segment on gun control. Supposedly, the ATF agent contacted the D.C. police to find out if the District of Columbia — the place where the show is broadcast — had a law prohibiting such a display. The D.C. police official responded that Gregory could legally show the magazine, provided it was empty. TMZ concludes that “Meet the Press” may have gotten conflicting answers from D.C. law enforcement. However, based on the wording of the statute, it’s difficult to see how it can be interpreted as allowing possession of a magazine, whether empty or not.

No person in the District shall possess, sell, or transfer any large capacity ammunition feeding device regardless of whether the device is attached to a firearm. A “large capacity ammunition feeding device” means a magazine, belt, drum, feed strip, or similar device that has a capacity of, or that can be readily restored or converted to accept, more than 10 rounds of ammunition.

so does this fall under the general $1000 maximum and no more than one year or the 10,000 ten years for illegal amunition?
XII. General Penalties Pursuant to D.C. Official Code § 7-2507.06, any person who violates certain provisions of Firearms Control Regulations Act, as amended, shall, upon conviction, be fined not more than $1,000 or be imprisoned for not more than one year, or both, except that: A person who knowingly or intentionally sells, transfers, or distributes a firearm, destructive device, or ammunition to a person under 18 years of age shall be fined not more than $ 10,000 or imprisoned for not more than 10 years, or both. (A) Except as provided in subparagraph (B) of this paragraph, any person who is convicted a second time for possessing an unregistered firearm shall be fined not more than $ 5,000 or imprisoned not more than 5 years, or both. (B) A person who in the person's dwelling place, place of business, or on other land possessed by the person, possesses a pistol, or firearm that could otherwise be registered, shall be fined not more than $ 1,000 or imprisoned not more than 1 year, or both. A person convicted of knowingly possessing restricted pistol bullets in violation of § 7-2506.01(3) may be sentenced to imprisonment for a term not to exceed 10 years and shall be sentenced to imprisonment for a mandatory-minimum term of not less than 1 year and shall not be released from prison or granted probation or suspension of sentence prior to serving the mandatory-minimum sentence, and, in addition, may be fined an amount not to exceed $ 10,000. Additional penalties may apply.
