California accident insurance question

My son was involved in a minor accident a couple days ago in LA. Without going into too many details, he says it was her fault. She initially agreed, but is now changing her tune. Basically, he says she turned into his car to make a turn without looking, and hit him along the side of his car. She is saying he turned into her. He was just driving in his own lane and did no turning.

There was no police report (I know, big mistake). He has liability only insurance. She has full coverage with Mercury.

There's a lot at stake for him: In addition to the approx $1500 in damage to his car, if he gets dinged as at-fault, his rates will go way up.

How to best proceed?

California accident insurance question

There's a dmv form that needs to be filled out. She'll put in a claim through her ins. co. and they'll go after his for the cost. That should be the end of it and in theory he'll never see or hear anything more about it.

He should be damn glad he wasn't hit by someone with no insurance (there are a hell of a lot of them in LA).

Call his insurance person ASAP. Explain and write this down so that his agent can proactively address this. File a police report.

I have had this situation for clients about three times this year. He needs to make certain that his insurance person is advocating hard on his behalf.

When Mrs. Lee got hit by a neighbor backing out of her driveway, neighbor also admitted fault and then changed her tune when the insurance company called. Each insurance co. said the other driver was at fault, but because the neighbor refused to give a statement to our insurance co., they agreed on splitting fault 50/50.

Someone backed into my car in a parking lot about 10 years ago. I was nervous that he was going to say I rear ended him, so I got out my cellphone, turned on the memo recorder, and recorded him with his permission saying that he was at fault. I would try that next time, but too late now. Good luck to your son.

Get a lawyer! If you don not the lady and her insurance company will be after your whole family like flies on........
