I smell a lawsuit and so does the clinic

Our bookkeeper's son was diagnosed with metastasized stage 4 melanoma about 3 months ago. He should be dying about now. But he got a call from his doctor's lawyer yesterday saying there had been a mistake in the lab and he has a benign tumor. He is roller coasting through a range of emotions now. I can't imagine.
It's good news for him, but some poor person out there thinks they are living the life and they are very, very sick.
I think the fact that he got the news from his doctor's lawyer, not his doctor, says it all about what they are expecting.

I am a firm believer in getting a second opinion. This situation could have been avoided by doing this. I am not a believer in lawsuits. Their choice of course.....

Great that they corrected that mistake. Let's hope they don't get punished for coming clean.

This is assuming it was a mixup and there is in fact another party who recieved the bookkeepers sons diagnosis.

Could of been playing it safe with the bookkeeper because you could still sue for some sort of damage, perhaps mental anguish or something like that.

Right, so the lawyer could be calling anticipating a lawsuit from the bookkeeper and not another party who was misdiagnosed

Not sure why the doctor wouldn't just call the patient himself. If it was a lab error (i.e. specimen mix up) then your bookkeeper's son is a lucky guy and should throw himself a party. If it was a misreading by the pathologist, that's not the dermatologist's deal either.

Having said that the guy with the benign tumor should just throw himself a party and not worry about whether he can file a lawsuit. The guy with the end stage melanoma may well have a case due to the delay in letting him know the diagnosis but as stage IV melanoma is really not treatable anyway he will have trouble showing actual physical harm. Mental anguish, loss of time to get his affairs in order yes but he was terminal three months ago.

Was he being treated for cancer? It would seem to me that treatment would have been started by now. Why wasn't he sent to a specialist immediately following the diagnosis? Seems like some pretty poor medical care he was receiving.

Kinda justified if there's a suit... Not the moral anguish, it's more of a reboot of your life.

More re: stuff he might have done to prepare his family, like sell a second home, or his early 911S cheap (because he was gonna die), and now he wants it back...

I could see a suit by the unlucky SOB second party that gets the late diagnosis.


If I was the boy though, I would spend the day with my family to celebrate. Maybe buy a bottle of good booze. Hell I might even find religion at that point. The last thing I would be looking for is a lawyer.

My son has been in and out of the hospital three time for something that may or may not have been avoidable the first time. Weeks of sleepless nights and watching what was a healthy young man packed in ice and in pain.
I just wanted my son back and healthy. Everyone is telling us to lawyer up but my son is out of the hospital now and if he is fine I will be watching him leave for Europe and his study abroad in a few weeks.
I get the lawsuit but when things end well and you have a new lease on life why spend time looking back at crap when so much good stuff is in front of you

Reminds me of the economist who says on the one hand the economy is going this way and on the other hand it is going the other way.Needed a one armed economist. Then you need a urologist who has one finger only........

The world is full of people looking to hit the law suit lottery.
That is why we have so many lawyers, and why insurance costs us all so much.
And why all the products and services we buy cost so much.
And why we have so much ridiculous gubmint regulation.

I liked it better back when people weren't greedy enough to screw each other over for a dollar.
It really is a shame.

But hey, as long as they get the money who cares how much it costs other people! SCREW EM ALL!!!!!!!!
