no love from CHP
in the infinite wisdom of the California Highway Patrol, I am SOL. I should have been able to avoid the concrete. Doesn't matter if it was moving, or how it got there, or the fact that not a single car got through the debris field without damage.
and to add insult to injury, I got a $25 ticket yesterday for not having a front license plate...from a meter maid. |

SoCal is cracking down on front license plate voilators because if the red light running photo ticketing thing. The biggest bummer is that they have give you a ticket if your 911 is just parked on the street without you even there!!! Now that's harsh.

What does the CHP have to do with it? Are they now the judge and jury? You can bring suit against the driver that caused this debris to fly in your direction in small claims court. I think the limit has been raised to $7500. SCC is very sympathetic to financial loss. In fact, that's all they do. You need to demonstrate that the other driver caused a nuisance thru neglegent action. Why not name CalTrans in the suit as well for having such a crappy wall? I'm not a lawyer, nor do I play one. You have your own lawyer, I believe. What does she say?

I was going to concider leaving the plate in the front window on the dash when parking on the street. I haer the Tuner cars get away with this technique. Also do not park at LAX with out a front plate. They are there 24 hours a day busting for no front plates! I think it is for security when vehicles enter the lots they are on video.

Couple of more things: That red light suit was an older one I believe when the camera was new and the timing was off. And on the CalTrans, wasn't Todd's accident on the freeway? No matter, name the city then.

I'm arguing with them right now on the phone...they won't add me to the original incident...they will only write up a separate one where I'm not at fault (but neither is the first person).
He's also saying that the concrete would come to rest after a second or two. I think I could get a physicist or engineer to argue otherwise...he did say that he's never seen a passenger vehicle do that kind of damage to a K-rail. |

well, I'm screwed as far as CHP is concerned. Judge, jury and executioner...done deal. I cannot get the driver's ID no way no how. She (he did let some things slip) was arrested (likely DUI) and was driving an SUV.
So...anyone gone after Caltrans before? |

Nostatic-
I think the CHP would be a bit more willing to cooperate if they were contacted by your legal representative. I know it's no fun, but sometimes hiring an attorney is the best course of action. IMO, you are being lied to in order to avoid the hassle of managing this case. While CHP may not be responsible, they should be more cooperative (police: to serve and protect?) in helping you resolve this matter. |
