JIM Pierce: sent money then he disappears

Can anyone help?

I bought these S brakes from a Jim Pierce

Early Porsche 911 calipers

He has also sold some other parts on PP. At first he replied quickly and was helpful, but now his emails bounce and my brakes have not been sent. This is my first bad experience in over 4 years of Porsche buying and selling on the internet.

Can anyone help, Wayne anything PP can do. His email was
Cellerdweller613@cox.net

Fingers crossed he gets in touch soon so I can put all this behind me.

Thanks

Alan.UK

Alan,

Can you post his name, address, telephone, e-mail etc? How did you pay? Where was the money sent? Where is the money now?

Perhaps some Pelicans can help. There could be a perfectly innocent explanation. On the other hand I think most of us won’t tolerate any sleaze here.

Best,
Grady

Hmmm, Jim Pierce has only eight posts.....that's not a good sign.

Hopefully he comes through. Good luck.

Also, his "homepage" is still up but doesn't mean he has an active account. http://members.cox.net/jamespwalker/

Thanks Grady and Rick,

His name is Jim Pierce and his email was

Cellerdweller613@cox.net

I didn't get his number or address, I guess I am far too trusting. I paid him via PayPal and they can't help either.
He also sold some gauges on the for sale section, but I have already tried to mail the people on there asking for help

Porsche 911 misc gauges

I hope there is an easy explanation, as I really don't want to become a untrusting chap.

Thanks in advance

Pay Pal can and will file a dispute and take money from his account for non delivery. They do it every day and are very good about following up to get the problem resolved.

You will also have a physical address from your PayPal reciept.

If an uncomfirmed address it could be a fake. But I'm surprised PAypal doesn't offer the option that rdane mentions.

Another avenue is to contact his ISP, Cox communications and see if there's a replacement email.

You can only dispute Paypal transactions within the first 30 days.

Not true.."non delivery" can be disputed for a much longer period of time.

How did you pay? With a credit card or directy from your bank? When ever I use PayFee, I always use my credit card gives me the extra protection incase PayFee doesn't want to help out. Most of the time they do have a time limit of 30 days, but that just with auctions with Ebay(Efee) I dont know about regular transactions

Looks to be 30 days.

From PayPal:

"Protection Policies

How do I report potential fraud to PayPal?

...If you have sent a payment, but have not received your item, or believe the seller to be fraudulent, complete the Buyer Complaint Process...."

...

"Buyer Complaint Form

PayPal works hard to make transactions made within our community safe.

If you have been unable to resolve a dispute with a seller, you may file a claim that will be reviewed by a PayPal investigating agent. Before you file a claim:
Check the Help Center. Often times you can get quick answers to your questions. In fact, you may find filing a claim is not necessary

Make sure PayPal was used to pay for the item(s) in dispute

Check the date! All claims must be filed within 30 days of the transaction or the claim will be denied

Be ready to provide agents as much relevant information regarding your claim as possible. Buyers who don't respond when asked will have their claims cancelled. Sellers who don't respond will default the claim which automatically refunds the buyer

If it's an eBay purchase, review the listing. The information found there will be used to evaluate the claim."

Additionally

If you purchase the Buyer Protection coverage (Read: Insurance Policy) your timeframe is slightly extended.

"PayPal Buyer Protection Rules

... Claims must be filed within 45 days of the PayPal payment..."

Just my own experience but I had a claim filed a little over 6 months after payment.....for "non delivery". Surprise to me and it was solved immediately but the funds were charged against my account the day the claim was filed...a full 6 months after the original payment.

That was almost 6 moths ago to date.

Youy have nothing to lose by filing with Paypal. Why are you delaying? Ther worst outcome is no worse than where you are today.

I use Pay Pal on a daily basis in my business. Have for several years, long before Ebay bought them. Still use them and am happy with the results as a business, a buyer and a seller.ymmv

Sometimes the local police will help depending on where you live. A friend of mine bought some Mercedes wheels on Ebay and the guy never shipped. He said he spent the money and didnt have more money to ship them. My friends wife call the police, made a report and they went to the guys house and the guy somehow got the money to ship the wheels. It wasnt looking good for awhile though.

If you can get the guys address you may file a police report in his city and see if that works if nothing is resolved soon.

Thanks guys,

I will contact PayPal again and also my credit card company as I paid with that via PayPal. Besides contacting his service provider I do not know how else to get his address.
If I had his address I would think about going over to the US for a holiday to send him a big British hello.

I will let you know how I get on.
Thanks for the support

Alan
