Yes, any situation can be spun into someone else's responsibility by a lawyer. However, it also states in the linked article that the victim was
ejected from the vehicle. Given that fact, no amount of fully functioning air bags would have saved his life.
Of course, that just means the spin will now focus on the construction of the car and the inadequate anchoring of the seat/seat belt, or irresponsible design ala Paul Walker.
