No search and seizure issue as the constitution limits what cops can do so they have to make up little tricks such as "did you win?" (which is analogus to "count backward from 100"). The lack of Miranda rights being read IS a big deal. The reason you read these is to warn the person at their "arrest" that they have rights. Arrest=when you are detained against your will. Advice= plead not guilty, play dumb w/racing. Cop can't prove that race was going on (unless there was another cop there who will definitely testify that there was a race going on!) (also-cops WILL be there, they get paid overtime to attend!). Have girlfriend come to substantiate, bring up lack of rights. Trick is to make it into such a giant **** storm that jury/magistrate/whatever has no choice but to say ... lack of proof, not clear beyond a reasonable doubt, etc. Best advice = get attorney (slow down?)
