I agree, back off or flee if you are the biker.
I don't see a lot of lane splitting here in Michigan, guess our traffic isn't that bad. However, I have seen it once or twice and I think the rider had a death wish - idiotic.
Back in 1983 when a cop car tried to get me to go over the speed limit by tailgating me, he either on purpose or by accident made contact with my rear tire. I almost lost control and the cop car backed off. In fear for my life I down shifted and sped off doing 100 mph in a 45 mph zone - the cop did not give pursuit, I sort of wish he had so I could have my day in court. Two cops in the car, and only one of me, I'm sure they would have lied their tails off. Cops always lie in court, and I am unfit for jury duty as a result of my experiences.
