The lawsuit will fail because PH is not discriminating, the the ADA (or ADAAA) does not apply to private websites. Private in this context means membership required, limited entry, or not owned/managed by a government entity or entity providing services to the public on the government's behalf.
At my work, we just went through a huge ordeal for our websites on ADA/ADAAA and new privacy regulations.
Side note, what was this guy expecting in terms of subtitles?
