The problem I see is there would be no need for HOA's if everyone had "common sense".
Having a rule that says something like "Grass must not be more than 4" tall" may seem strict and unreasonable, especially if your's happens to be 4.5" tall. The problem lies with if 4.5" is ok, why not 5"? What about 6" etc, etc, etc.
If everyone had common sense, you could simply say "Keep your lawn and a presentable height" and everyone would understand the spirit of the rule. But sadly, there are those who think "Above the roof of my 1974 Gremlin is 'presentable'!" so we end up with very specific HOA rules. I don't agree with all of them but I do with the vast majority.
