Lots of uncontrolled airspace below 18,000 feet. Above that, everybody must be on an instrument flight plan and in communication with Air Traffic Control.
Below 18k, unless one is near a major airport, a transponder is not required.
The vast majority of airplanes have transponders so one does not have to skirt around the busy areas.
Blunder into LAX's airspace, and the pilot may end up having a little chat with the FAA.
