Joe. nice of you to look out for (what I assume is) another lister. there isn't that much danger for him though, as the picture you mentioned doesn't prove that he took anything. posing with "the spoils of victory" is not illegal and subsequently not subject to court martial. however, (and this was probably your concern) taking certaing things just might be, depending on what the circumstances are. he obviously didn't appear to complain
