That's what they're leaning on. And I'm fine with that if they don't accept responsibility and tell me they'll fix the car. To me it's not about what is "legally" right or wrong. At this point it's that they gave me their word they'd fix the damage done to my daughter's car and then ran away from that. Good people just don't do that. I wouldn't care if my insurance gave me an out. I'd pay the damn bill because that's what is right.
I'm going to talk to an attorney and get their take on this. I think I have enough proof to support them claiming responsibility. No reason they'd have the estimates if they hadn't said they'd cover the damages. I know I'll pay more than the 2K to an attorney and there's no guarantee I'll win, but the principle behind all of this is worth fighting for to me.
