If they don't test for impairment or the presence of drugs, the rest is semantics.
Had a booze jockey run a stop sign going about 20 over the speed limit, flee the scene, be chased down and run a stop sign trying to escape. Was forced to the side of the road by two good Samaritans, told that they had his license plate number so he might as well go back. They returned to the scene and gave a statement. Smelled booze on the guy who ran the stop sign, until he started chain smoking cheap cigars. Advised the officer what I do for a living and what I had observed. Given the smell and his antalgic gait, he was impaired in some way, likely due to alcohol. They gave me a card with the report number on it, asked if I wanted them to call a tow truck and that was it. The aforementioned booze jockey was allowed to drive away in his own vehicle. I wonder what could explain that?
