I dunno man, but Va DMV is the modern Nazi's. You are by default,, wrong until they say you're right. From your post you don't have legal rights as the title is not yet in your name. Very risky situation, as I have unfortunately been in similar circumstances and wisely choose to get the paper on my name, then work out the kinks.
