Sympathetically agree but can also understand why there was no mention. Can't imagine that the driver isn't at risk to lose everything he has over this, especially if someone in the van was severely/permanently injured by an event that was entirely foreseeable, preventable and captured on video.
The car required constant braking to hold speed at idle and he built it and he fitted undersized brakes and then those brakes totally failed to appreciably slow the car--what is left for his argument?
