If I pointed it at him, or anyone else, and pulled the trigger to find there was a live round in there and a person is dead? I'd have made a bad decision, employed some willful negligence, and killed somebody. I'd deserve prosecution and punishment. There are many less-stupid things prosecuted every day than pointing a thought-to-be-unloaded firearm at someone and pulling the trigger.
If I remember correctly (I may not) the Baldwin deal occurred not while actually filming a scene where he fires at the camera, but just before with a bit of horseplay.
