Well...if you've crashed on a public road at speed because you were driving like a dick, then you've committed a crime. In that case I guess police can seize evidence just like any other crime. Or yes, perhaps off to jail depending on what damage you've caused.
This bill is being sought because a dick in a Lambo Aventador was driving like a dick, lost control and hit two teenage girls at speed. They were just walking home from the shops. He killed one, and seriously injured another.
