I would initiate a return to Amazon and just buy a new one at the same time.
If the problem occurs with the replacement then we are reasonably assured it's something in the the transfer / from the old device.
At that point get Apple support involved.

So the other day (Wednesday?) my wife decided to return the new one and buy another one. She initiated the return but when she went to buy another one it wouldn't let her. She waited a day and tried again, same thing. Was told she'd have to wait until Friday before she could order another one. She tried again and chose a different color. It allowed her to order the new color. Go figure.
When this new one arrives today, I'm going to fully charge it, without using it, then allow her to try using it without downloading any of the stuff from her old one.
I figure if it works, then it must be something with the downloading that caused the problem.
I'll take it to the Apple store myself if it doesn't work once we download all the stuff off her old one.
The first new one will be returned to Amazon once she's got a working new one in hand.
