True until the cost of said litigation exceeds the claim. My old truck was totalled while parked in a private lot. Car jumped the curb and ran across the lot hitting 3 cars. Her insurance never paid from what I was told. I got paid off and bought the truck back. I negotiated with MY ins co, not hers.
