Horner is on record that Checo noted last year that they were developing the car aerodynamicly away from his balance preference, and that the team continued this trajectory this year to the point that they went beyond Verstappen's preferred balance.

Moreover, the rules clarification really was a restatement of the rule, just in greater detail. It was already illegal to have a biased brake on the same axle.
