I don't buy it.

If they said the doctor completely forgot about offering the test it would make more sense.

I can't imagine any doctor taking the time to discuss a state required test then not offering it. More likely, he told the couple the test was optional (true) and it was unlikely that the child would have spina bifida anyway (also true). Then I suspect the doctor neglected to have the patient sign the form officially declining the test.

Dot your "i's" and cross your "t's". It's a tough business. They haven't found a way to sue god, so the doc has to pay.
