Citizens can enforce the pollution laws -- and do. They are usually more stringent than the reg. agencies. Here it would be the state agency. The only exception would be if it was so bad it triggered CERCLA (the 'superfund' law) and the state agency didn't deal with it. Then EPA can come in.
