back to the issue.. "otherwise if judges keep shaping society to their whims the issue gets worse. I don't like a top down gov't."

The courts have been used to shape society thru rulings on "due process" lawsuits. The failure of progressive groups to achieve their agenda thru the legislature after WW2 forced them into the courts. This split in the social values created two distinct groups, the traditionalists and the progressives.

The clearest rejection of the progressives policies was shown in the last Pres election. As what happened in the progressives legislative failures, the astute progresive politicans today are chanting tradition and values. Those progressive politicians that don't recognize this will eventually be jobless.

The formerly political netural "religious right" has been seeking tradition and values in the Rep party because the Dem's are into co-ed dorms +++ etc. The yahoo conservatives is an outgrowth of progressive instilled erosion of values since the ending of the 'Nam war.

fwiw.
Hillary has been currently speaking of returning "values" to children and family. So if I'm correct in believing that the Clintons are great politicians then that means the progressive agenda is an acknowledged failure. Hillary isn't a bs-ing Pres wife anymore. She's appealing to the population center in the greatest challenge of her life. She wants to clearly define right and wrong and appeal to both parties' center .

Therefore, "otherwise if judges keep shaping society to their whims the issue gets worse. I don't like a top down gov't".
The push to the legislature by the yahoos with the support of the "religious right" is a forced necessary arena where values and tradition can be broadly discussed and argued. The bottom-up approach to social agenda puts the future with the people, not the progressive selected "judge of issue". I gotta agree with Hillary on this one.

"Check out the US constitution sometime." ....... ok

"Judges aren't spending the money, the (currently republican) congress is."

I never wrote that judges were spending money.

Congress is like a drinking party with an unlimited credit card. Sabraines-Oxly sic disclosure policy on corp's should also include Congress.

Currently Congress spends the money and refuses to react to negative performance evaluations of its programs. Taxpayers can't even sue for damages. Those that break the public trust thru malfeacense sic should be prosecuted...

For entertainment watch the high tax Blue State voters get whacked with the Alternate Minimum Tax/ AMT now, and more and more in the coming years compared to the Red States. State taxes + all kinds of deductions don't apply under S-O. It's obvious that the high state tax states also pay relatively high Fed taxes now. This means that the Blue state Dem's have been subsidizing the Red states already. It'll be kinda wierd watching the Dem's seeking tax reform in order to lower taxes.
