yeah, but if the bartender admits to serving someone he thought might be drunk, the bar itself could be in trouble. Heck, if a bartender had seen it all go down while dumping the trash and went out to help the guy pick himself off the ground, the bar could be in trouble.
When I was 16 i worked at my parents' restaurant/resort. Part of my duties were to help boats / jetskis dock and fill up with gas. I remember one time a boat that was loaded way over any reasonable limit started sinking 10 feet away from where I was standing. My dad happened to see it and he ran out to tell me that I couldn't help them. Now, the water is only 5-6 feet deep and they were maybe 30 feet from shore. If they would have been in danger of drowning, we probably would have helped. But we weren't allowed to jump in to help unless there was clear danger, so we had to just stand and watch their boat sink. Man, they thought we were asshøles.
