This is why it is not unconstitutional to deny a driver's licence to an illegal alien. Though a few years ago I recall the 9th Circus Court saying it was unconstitutional to deny free healthcare and education to illegal immigrants, so maybe they do have the same rights as a citizen.
So say we are at war with a country, Canada, because they sell Maple Syrup too cheap and are bankrupting Vermont. If a Canadian citizen is captured, driving copper spikes into Maple trees to destroy our ability to produce Syrup, do they go to jail or do they go to military prison? We are not really talking about crime, we are talking about a war.
