Your UCMJ recollections are failing at one crucial point: I think it's Article 90. Nobody is required to obey an illegal order. and, I believe, talking about illegal orders and their consequences is protected.

Now I am totally lost. Are you saying that Kerry gave someone an illegal order or stuck a superior officer? What does that have to do with Nuremberg? Germans were not subject to our UCMJ. Article 90 has to do with assaulting or willfully disobeying superior commissioned officer.
