The problem with your scenario is "who" identified the man as a child rapist? His neighbor with which he's had a running battle over fencing issues? Someone who owes him money? The government?
If I found a man raping a child, then there's no issue, he dies because I'm lawfully defending a person unable to defend themselves from a violent crime in progress.
