I apologize if this has already been brought up, but instead of one class action suit why not a whole bunch of small claims lawsuits? Each person who has been wronged can act as a witness to the other.
By doing that the owner of MM would have to show to each and every court date or lose by default.
The only drawbacks are the small claims max amount (I believe $7500) and the fact you have to file in the defendants area so out of state folks would incur some travel expenses.
