Hire a good lawyer on a trustworthy recommendation.
Sue the at fault party.
Don't even bother talking to the adjuster.
Have your lawyer write a letter to the insurance company outlining the bad faith negotiating tactic he/she used. Send a copy to your state's insurance comissioner.

This is a no-brainer for competent local counsel.
