Dave, let me start this off by stating I am an attorney in Missouri, not NC and I don't know NC personal injury law. But perhaps this will be of some help. First off you should get rid of the attorney you have and get one that knows what they are doing in the field of personal injury. The attorney you use for business law should be able to give you a good referral. Second, has your attorney sent a demand letter to the insurance company to get them to pay for your damages? If not that needs to be done immediately. In Missouri interest does not run on the dollars for damages until the demand letter is sent out. Third, after two years of a run around by their insurance company your attorney should have by this time sued the party that hit your wife's car; that is the driver of the car. Finally, if you had full coverage insurance at the time and need the money now, make a claim with your insurance company for the medicals. If they pay up they of course will be able to get that money back from whatever settlement you get from the other side's insurance company.
