Perhaps there may be a precident-by-usage, or whatever legal term is used for that.
If the neighborhood has always been that way then there might be some ammo for your side. Old photos/affidavits/etc..?

You can be sent a copy of the HOA bylaws, and any changes/updates in managment to review, and get the "no complaintant" in writing. Mabye a referal from the local BAR will give that a free/low-cost review to give you a better picture.
If the HOA bylaws are contrast to any city laws that would supersceed it....

Who represents the actual owners rights, and are they?
If a group of neighbors start asking where their money is going and why, the new(?) board might start with a different approach. Bring out the pitchforks and torches!
