Ironically, it was under Bush 1 that knowingly outing an undercover operative became a treasonous crime. It's called the Intelligence Identities Protection Act of 1982.
The neo conned have tried every tactic to explain away the illegal nature of her outing. And it mostly comes down to that 'knowingly' part -- which
AFAIK is the key reason Fitzpatrick didn't play the treason card. There is also the question of whether Plame was undercover overseas in the prior 5 years before her 'outing' which is a condition of this specific law.
