Contracts usually have some boilerplate language about requiring employee to comply w/ rules and regs of the employer; contract needn't expressly prohibit CHL. What might be more effective to protect her is if union contract has procedures about grievances and disciplinary process. Don't know how well organized the teacher's union is, assuming there is one.
I hope she wins, but I wouldn't put money on it.
