FWIW, I was rear ended twice in three mos. in my 330i. The last time was Aug. 24th, when a German au pair hit me so hard I thought the change in my backpack was gonna break my windshield when it flew out like buckshot. She was clearly at fault and the cop said so himself. HOWEVER, when he came over to talk to me about insur. and paperwork, he said he didn't know what he could charge her with!!!!! I said, "How about failure to maintain control of her vehicle?" He agreed, but said it was worthless because she was going back to Germany forever four days later, would not pay the fine, would not show in court and her US license wouldn't matter anymore, since she had a German one too. He also said that her not getting a ticket would not affect her at-fault status and her insurance would be responsible. And State Farm has agreed to pay for everything and is even working on my diminished value claim now.
