Actually, the new ones can be turned on remotely, and you'd never even know it. Just the microphone can be activated.
You have to physically remove the battery to prevent it being remotely powered on.
The feds took down some mobsters using this little tactic about a year ago, maybe. I'll do a google and post a link if i can find it.
