It's actually if you are even caught trying to put the key in the door to unlock it. I.E. you are really are not going to drive, but were not drunk enough to remember that you left your cellphone in the car and go out to get it while the car is parked on the street.
I always wondered if you could still be arrested for DUI if you don't have the key that actually turns the ignition. After both of the ignition switches have failed in both my cars, I now have a key to open the door and another to start the car. In the case of my Toyota, the door key and ignition key are separate.
