For example (really happened), Joe gets a DUI in his brand new pickup truck, license is suspended. Joe abides by the law and doesn't drive. However, one Sat. morning he backs his truck out of the garage onto his driveway and washes it. When finished, he pops a brew and sits in his new truck, engine off, and fiddles with his new high end audio system. Ossifer rolls up and b b b b busts him with another DUI! On his own freakin' property!

I'm sure it happens. My wife, who used to be a DA, once turned down a case the Costa Mesa PD filed where the guy was sleeping off being drunk in the back seat of his car in the bar parking lot (the Goat Hill Tavern for you locals). The cop knocked on the window. The guy didn't wake up. The cop unlocked the door with his slim jim, hauled the guy down to the station, and he blew over 0.2. Technically the guy was guilty, but he was totally passed out, and no danger to anyone so she rejected the case. The CMPD then re-filed the case, and made a big stink so another DA had to try it, and ended up with two mistrials before they gave up. What a waste of taxpayer money....
