Well, another barrier would be plaintiff attorneys having the morals to not take the case.
But, at the same time, I understand that all you need is
one personal injury JD (who probably advertises on the side of a bus) to "put his client's best interests" above the expectations of common sense and go after the RR company's deep pockets.
