The problem may be is that there is no "wheel witness."

Proving who the owner of the car is no problem. Proving who was driving the car is a whole different story.

I'm sure the driver/owner has probably already gotten legal advice and won't be giving any incriminating statements to the police any time soon.

It's a very sad thing but it does happen much more than one would actually think.

They could however check cell phone records and see if the owner made or received any calls near the time of the incident.
