The buyer has no ownership in the damage. He received the item damaged. It is the sellers responsibility to deliver the product in the stated condition of the sale. This idea of the buyer paying for insurance and accepting the care and feeding of the sellers inability to properly ship a package is an E-Bay phenomena. If you order an LCD monitor from someone and it arrives broken are you going to say " thats okay I have insurance and I will handle all negotiations with the shipping company". No, you send it back for replacement or for refund. Of course this only works for credit cards, if pay by cash or check you are at the mercy of the seller. If you give up control as a buyer you accept the outcome.
