Well, unless you consider research harpooning, butchering and then selling whale meat/blubber...yeah I would say what they are doing is against international law. You can have a debate at to whether Japan chooses to recognize that international law, but it doesn't change the fact they are violating that law.

The whalers are also operating in a gray zone, sometimes they get arrested, sometimes not. Personally I find the whole thing ridiculous from both sides.
